 Within the framework of the request for the integration of Avianca and Viva, with the objective of strengthening the airline industry in Colombia:

Avianca filed appeals before the Aeronáutica Civil requesting clarifications and minor modifications to the last resolution issued

  • In order to make the integration viable, the appeal filed requests clarifications and minor modifications to the resolution issued by the authority, so that the conditions set forth therein may be applicable to the reality of the current market and to the operating conditions -network of routes, aircraft and workers- currently available to Viva Airlines.
  • Within the framework of this process, which began more than eight months ago, it is essential to seek quick solutions that will safeguard what remains of Viva Airlines today, in order to continue maintaining the low-cost model in the country and guarantee competitive prices for the benefit of Colombians.
  • The request includes the availability of Viva's capacity in terms of aircraft, so that they can meet the country's connectivity needs, as well as resolve the situation of the low-cost carrier's users.
  • In the midst of the situation, Avianca has been the only airline that has maintained the free relocation of affected passengers on a sustained basis. To date, it has already transported more than 100,000 Viva and Ultra users, even during the high season of Holy Week.

Boston, April 5, 2023.  Within the framework of the integration request between Avianca and Viva, which was initiated more than eight months ago, after a detailed review of the conditions set forth by the Aeronautica Civil, Avianca filed appeals in which it requests clarifications and specific modifications that allow the conditions to be viable and applicable in light of the current reality of the country's air market and that really make the low-cost airline's operation viable.

In the current context of the Colombian air market, it is essential to activate quick solutions that provide stability to the system and avoid further damage due to the loss of aircraft, routes or jobs that still depend on Viva Airlines. Therefore, the appeal seeks, among other things, to allow Viva to sustainably operate a minimum number of aircraft from El Dorado airport, while providing ample space for airlines that want to fly to and from Bogota. In addition, Viva's operation during peak hours will focus on regions that require extensive connectivity, such as San Andres, Leticia, Santa Marta and Riohacha.

With regard to passenger protection, Avianca accepts, in general terms, the conditions aimed at protecting passengers affected by the temporary cessation of Viva's operations, including those who had purchased 'Viva Pass' ticket books with the low-cost airline.

In this regard, Adrian Neuhauser, President and CEO of Avianca said: “The purpose of the appeal is to guarantee the minimum conditions to be able to operate what is left of Viva and thus preserve connectivity

in the country and the supply to passengers. Since day one we have provided solutions and protected hundreds of thousands of users that have been affected. We categorically reject the insistence of some competitors to hinder the process with the sole purpose of eliminating what is left of Viva.

Taking into account the urgency of the affected users to resolve their situation, as well as the need for stability in the Colombian aeronautical sector, we trust that Aerocivil will analyze the clarifications in light of the current reality of the low-cost carrier.”

Finally, Avianca highlights that, seeking to preserve the stability of the sector, it has led the protection by having relocated more than 100,000 Viva and Ultra users free of charge - 86% of the total number of passengers of both airlines -, being the only company that has maintained the relocation of affected users free of charge on a sustained basis.
